SUBBYS is TOMORROW!  Why Didn’t You Register?
Tomorrow, Saturday, Feb. 22nd, much of the construction industry will be enjoying a festive night of entertainment and fun; but most of the emphasis will be on the individuals and companies to be recognized for their excellence in partnering with subcontractors. The votes are in and Lanigan Ryan is determining who will receive the iconic trophy that recognizes the SUBBY recipient.  We rarely say “winner” because every nominee is a winner. Watch for the list of recipients on Social Media and in emails from us.  


No Contracts Affected by Trump EO’s
No members have reported their contracts being stalled or cancelled by recent executive orders by the President.  If yours has, please report by reply to this email.  Members working on projects financed by the Infrastructure, Investment and Jobs Act of 2021 (IIJA) or the Inflation Reduction Act of 2022 (IRA) should review this article provided by Piliero Mazza.  It includes seven steps you should take if you think you are going to impacted by this executive order. 

Employment/Immigration
As we have reported in the past, temporary employees have a damaging effect on productivity.  This report from the Journal for Labour Market Research, provides a detailed study of this fact.  This is sobering news in our area as most job sites depend on temporary workers to complete projects on time.  Many of these temporary workers are immigrants who might or might not have the necessary documentation to work.   This Construction Dive article includes some suggestions to prepare for a visit from the Immigration and Customs Enforcement agency (ICE).  

Where is the labor coming from?  Members who are NOT upscaling and training the future workforce are stealing from the industry of tomorrow.  Another detailed McKinsey report details steps a company may take to address the lack of labor.  It includes:

  • Attracting talent from unconventional pools, offering more flexible work, and internal mobility.
  • Encourage foreign-born workers with programs to properly integrate them into the workforce.
  • Shape retirement policies to encourage people to work beyond standard retirement ages and take steps to attract more women into the workforce, for example, by offering elder or childcare infrastructure.
  • Prioritize investment in labor-complementing and labor-substituting AI and automation to unlock productivity.

ASAMW Supports Metro DC Hispanic Contractors Gala

Registration is now open

PLAs
Reports from the Dept. of Defense lead us to believe that Project Labor Agreements are on the wane in Federal construction.  So far, this does not affect construction on projects awarded by DC or jurisdictions in Maryland.  I would be interested to know how you are planning to adapt to these potential policy shifts.

MEMBER UPDATES

Thompson Greenspon announced that William H. Thomas IV, CPA has joined the firm as a tax principal, bringing nearly two decades of experience in tax advisory and family wealth planning.

ADVOCACY

DC – The DC Council is holding budget hearings through most of this month, but we have a commitment from Council Member Kenyan McDuffie to push legislation that will allow subcontractors to protect payment for work completed.

MD – HB 451 was heard on Jan. 29 in the MD House Committee on Economic Matters with ASAMW testifying for its passage. The current bill does not include the language promised by the patron making pay if paid unenforceable. Without that language ASAMW will not be in support of the legislation. The Chairman, CT Wilson of Charles County has a lot of influence on the future of this legislation. 

SB 494 is another bill that would have expanded the use of PLAs, apprenticeship and included other issues, was withdrawn by the sponsor.  

VA – The Commonwealth’s Legislature is in Session and ASAMW is monitoring bills that will protect subcontractors.  If you are aware of any legislation needed in Virginia to protect subcontractors, please reply to this email. 

Federal – ASA National is supporting a federal bill to simplify subcontract language.
