When it comes to indemnification, subcontractors are often the ones left holding the bag. Do you know what the indemnity clause in your subcontract says? Most construction contracts and subcontracts contain indemnity clauses, and if not carefully reviewed and limited, they can expose subcontractors to unintended consequences, including protracted litigation and substantial unanticipated costs. Worse still, a subcontractor may be forced to incur these impacts to protect and defend others who are partly responsible for the damages at issue.

On August 26, 2021, Mackenzie Bell and Brian Wood, construction law attorneys at Smith, Currie & Hancock, will offer attendees an opportunity to learn about a range of issues related to and implicated by contract indemnification clauses, including the principles of indemnification, anti-indemnity statutes, the interplay between indemnification and insurance provisions, and best practices in drafting and negotiating indemnity clauses, with the ultimate goal of helping subcontractors understand and limit indemnification obligations.
